As improvements in neuroscience have enabled a better understanding of disorders of consciousness as well as methods to treat them, a hurdle that has become all too prevalent is the denial of coverage for treatment and rehabilitation services. In 2011, a settlement emerged from a Vermont District Court case, Jimmo v. Sebelius, which was brought to stop the use of an “improvement standard” that required tangible progress over an identifiable period of time for Medicare coverage of services. While the use (...) of this standard can have deleterious effects on those with many chronic conditions, it is especially burdensome for those in the minimally conscious state, where improvements are unpredictable and often not manifested through repeatable overt behaviors. Though the focus of this paper is on the challenges of brain injury and the minimally conscious state, which an estimated 100,000 to 200,000 individuals suffer from in the United States, the post-Jimmo arguments presented can and should have a broad impact as envisioned by the plaintiffs who brought the case on behalf of multiple advocacy groups representing patients with a range of chronic care conditions. A argumentação desenvolvida no presente artigo se propõe a defender a interpretação austera do construtivismo em Kant das objeções a ela levantadas por Jeremy Schwartz (2017) em seu artigo _Was Kant a ‘Kantian Constructivist’?_. Tendo isso em vista, primeiramente, procede-se à reconstrução da interpretação de Schwartz para a distinção analítico-sintética na esfera prática a partir da caracterização por contradição e à indicação de objeções para sua aceitação. Na sequência, apresenta-se a caracterização de analiticidade por continência e como esta pode ser (...) transposta para o caso dos imperativos sem resultar em conflitos com a interpretação austera do construtivismo. Por fim, delineiam-se considerações quanto à formalidade dos princípios constitutivos da razão prática e seu escopo, chegando à conclusão de que não se pode estabelecer uma identidade entre construtivismo austero e logicismo prático. The article analyzes the phenomenon of national self-determination in terms of evolution and functioning. The authors aim to determine the general characteristics and evolution of this phenomenon in both conceptual and applied versions. In the evolution’s context of national self-determination as a theoretical concept and a political and legal principle, several stages were identified and considered. According to the authors, each stage of the phenomenon’s evolution was inevitably accompanied by its qualitative transformations, both in political and legal terms. The first (...) stage (from the end of the XVIII c. till the First World War), according to the authors, is characterized by the emergence of the idea and the formation of the socio-political concept of national self-determination, and the applied aspect of the phenomenon of national self-determination is filled with concrete content based on the ever-expanding political practice of its application. The second stage (from the First World War and the post-war reconstruction) is characterized by the transformation of self-determination from a concept into a political principle. The authors associate the third stage of the evolution of the phenomenon of national self-determination (the period after the Second World War) with the development of international relations and the formation of a global bipolar system. National self-determination turned into a principle of positive international law and laid the foundations for the future political instability of the newly independent states. Finally, the last period (the early 90s to this day) is characterized by the search and crystallization of new approaches to the principle of national self-determination and the emergence of new theories, the authors of which are trying from a political and legal point of view to substantiate the legitimacy of an expansive interpretation of this principle. The analysis allowed us to conclude that the qualitative transformations of the principle of national self-determination presented in the article did not lead to the formation of the phenomenon of national self-determination as an integral, complete, and universally recognized international political and legal norm. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

This article provides current Schwartz Values Survey (SVS) data from samples of business managers and professionals across 50 societies that are culturally and socioeconomically diverse. We report the society scores for SVS values dimensions for both individual- and societal-level analyses. At the individual-level, we report on the ten circumplex values sub-dimensions and two sets of values dimensions (collectivism and individualism; openness to change, conservation, self-enhancement, and self-transcendence). At the societal-level, we report on the values dimensions of embeddedness, hierarchy, mastery, affective (...) autonomy, intellectual autonomy, egalitarianism, and harmony. For each society, we report the Cronbach’s α statistics for each values dimension scale to assess their internal consistency (reliability) as well as report interrater agreement (IRA) analyses to assess the acceptability of using aggregated individual level values scores to represent country values. We also examined whether societal development level is related to systematic variation in the measurement and importance of values. Thus, the contributions of our evaluation of the SVS values dimensions are two-fold. First, we identify the SVS dimensions that have cross-culturally internally reliable structures and within-society agreement for business professionals. Second, we report the society cultural values scores developed from the twenty-first century data that can be used as macro-level predictors in multilevel and single-level international business research. Despite that it is commonly accepted that migraine is a disorder of the nervous system with a prominent genetic basis, it is comorbid with a plethora of medical conditions. Several studies have found bidirectional comorbidity between migraine and different disorders including neurological, psychiatric, cardio- and cerebrovascular, gastrointestinal, metaboloendocrine, and immunological conditions. Each of these has its own genetic load and shares some common characteristics with migraine. The bidirectional mechanisms that are likely to underlie this extensive comorbidity between migraine and other (...) diseases are manifold. Comorbid pathologies can induce and promote thalamocortical network dysexcitability, multi-organ transient or persistent pro-inflammatory state, and disproportionate energetic needs in a variable combination, which in turn may be causative mechanisms of the activation of an ample defensive system with includes the trigeminovascular system in conjunction with the neuroendocrine hypothalamic system. This strategy is designed to maintain brain homeostasis by regulating homeostatic needs, such as normal subcortico-cortical excitability, energy balance, osmoregulation, and emotional response. In this light, the treatment of migraine should always involves a multidisciplinary approach, aimed at identifying and, if necessary, eliminating possible risk and comorbidity factors. (shrink)

At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

In their paper, ‘How to reach trustworthy decisions for caesarean sections on maternal request: a call for beneficial power’, Eide and Bærøe present maternal request caesarean sections (MRCS) as a site of conflict in obstetrics because birthing people are seeking access to a treatment ‘without any anticipated medical benefit’. While I agree with the conclusions of their paper -that there is a need to reform the approach to MRCS counselling to ensure that the structural vulnerability of pregnant people making birth (...) decisions is addressed—I disagree with the framing of MRCS as having ‘no anticipated medical benefit’. I argue that MRCS is often inappropriately presented as unduly risky,without supporting empirical evidence,and that MRCS is most often sought by birthing people on the basis of a clinical need. I argue that there needs to be open conversation and frank willingness to acknowledge the values that are currently underpinning the presentation of MRCS as ‘clinically unnecessary’; specifically there needs to be more discussion of where and why the benefits of MRCS that are recognised by individual birthing people are not recognised by clinicians. This is important to ensure access to MRCS for birthing people that need it. (shrink)

BackgroundHuntington’s disease has a poor prognosis. For HD patients in the Netherlands, one way of dealing with their poor prognosis is by drawing up an advance euthanasia directive. Little is known about the perspectives of HD patients on their AED.AimTo gain insight into patients’ views on and attitudes towards their AED, and changes over time.MethodsA longitudinal qualitative interview study using 1 to 6 semi-structured interviews over a period of maximum three years. Nine HD patients who either had an AED or (...) were thinking about drawing it up participated in this study.ResultsWe identified two themes that characterize patients’ perspectives on their AEDs: general character of the AED; uncertainty around their AED. Ad The conditions that the participants described in their AED were generally not very specific for the person. Mostly they were general notions of unbearable suffering. Familiarity with HD in the family could play a role in drawing up an AED. Ad Participants generally were aware of the tentative character of their AED and could have doubts concerning their own willingness or the willingness of others in the future. Sometimes these doubts were so great, that it prevented them from drawing up an AED. However, patients did not alter their AED during the follow-up period or changed in their view or attitude on their AED.ConclusionHD patients that draw up an AED usually describe general conditions for euthanasia and recognize that these conditions may change as the disease progresses. An AED or the wish to draw one up may be a good conversation starter for conversations about goals and preferences for future care. (shrink)

What does it take for a subject to experience a personal memory as being her own? According to Fernández’ (2019) model of endorsement, this particular phenomenal quality of our memories, their “sense of mineness”, can be explained in terms of the experience of the mnemonic content as veridical. In this article, I criticize this model for two reasons: (a) the evidence that is used by Fernández to ground his theoretical proposal is dubious; and more importantly, (b) the endorsement model does (...) not accommodate many non-pathological everyday memories that preserve their sense of mineness, but whose veridicality is explicitly denied, suspected, not automatically endorsed, or neither denied nor endorsed. Finally, I sketch two alternative explanations: one also problematic, the other one more promising, and present some normative advantages of the latter. This also displays the undesirability of the endorsement model from a normative perspective. (shrink)

The article contributes to the understanding of how societal conflict, aggression, and racism are intertwined with the concepts of the body and necropolitics. Achille Mbembe’s exploration of historical conflicts refers to the way in which states and other necropolitical entities exert control over life and death. Persistent conflicts reflect a form of necropolitics in which certain groups are subjected to violence and death as a means of maintaining power. Frank B. Wilderson III’s analysis of aggression towards Black individuals reveals how (...) the body, particularly the Black body, is subjected to policing and violence. This speaks to the concept of necropolitics as it highlights how certain bodies are deemed expendable or “killable” in society, and how the policing of Blackness can be seen as a form of controlling and subjugating these bodies. The rationalization of racist acts against meticulously selected groups and bodies that are highly racialized in contemporary necrocapitalism illustrates how the politics of death and violence are used to maintain class and racist hierarchies and control over different bodies. The article investigates the peculiarities of Durer's aesthetic views in the context of Renaissance philosophy and the theory of cognition of Modern times. Its provisions are compared with fragments of texts by L.-B. Alberti, Leonardo da Vinci, Raphael. The semantic interrelationships of Durer's positions with mysticism, pantheism, natural philosophy and empiricism of Modern Times are emphasized. The interrelation of the problem of knowledge with the theme of freedom and beauty is considered in detail. The authors analyze various opinions and ways (...) of comprehending the beautiful, presented in the philosophical constructions of Durer, his concept of "rational knowledge", "scientific ignorance". Special attention is paid to the boundaries of freedom in Durer's representation. The novelty of the research lies in the fact that the presented concept of the evolution of A. Durer's aesthetic views helps to comprehend those contradictory trends that existed in the Renaissance itself. Thus, Durer believed that freedom conditioned by knowledge ends where attempts to transcend nature begin. A necessary condition for freedom is the understanding that the beautiful is relative. From the understanding of the relativity of the beautiful, from the concrete utopian program of its achievement, an imperative grows, meaning denial, the completion of the aesthetics of Rebirth. According to him, the artist should not limit himself to one type, but should be knowledgeable in various ways of depicting all kinds of types. In order to make such an image as is required of him. Thus, the professionalism of the artist, his experience, knowledge, recognition of the power of knowledge and, at the same time, understanding of its relativity – all this, as an achievement of the Renaissance theory of art, loses its meaning. El presente trabajo pretende abordar estos interrogantes dando cuenta de la necesidad de forjar un feminismo crítico que sitúe los discursos de género lejos de toda lectura fácil y simplista. Este desafío supone consolidar un movimiento feminista que problematice y desarticule ciertas categorías medulares de la teoría jurídica moderna; categorías que: a) han imposibilitado comprender la complejidad y desplazamientos de los procesos de constitución subjetiva. b) han ignorado las micropolíticas de la diferencia y las disputas/ renegociaciones que éstas implican. c) han presupuesto una temporalidad teleológica como marco de acción. d) no han dado cuenta cómo los paradigmas de excepción se han convertido en formas paradigmáticas de gobierno, constituyéndose en una de las esferas de inscripción moderna de la violencia sacrificial. In this Master's dissertation, I try to show that the causal theory of memory, which is the only theory developed so far that at first view seems more plausible and that could be integrated with psychological explanations and investigations of memory, shows some conceptual and ontological problems that go beyond the internal inconsistencies that each version can present. On one hand, the memory phenomenon analyzed is very limited: in general it is reduced to the conscious act of remembering expressed in (...) a propositional format: the idea of an agent who can control his memory reports, in contrast to a passive subject who merely retrieve his encoded memories, is not even considered. Furthermore, the representational function of memory is the only function taken into account; and all the diachronic changes that could entail a dynamic conception of memory are ignored, as is the consideration of context in a broad sense of the term. On the other hand, causal theories make some implicit assumptions that are obviously questionable (e.g., the difference between facts and events) and leave some of their key concepts unexplained, like the nature of the causality, the isomorphism between the memory trace and the memory event, etc. Nonetheless, the principal point that we criticized is the idea of a correspondence between a past event or representation of it, the correspondent memory trace and the memory representation of it. Psychological models of memory, with the exception of the spatial analogy, question some of these assumptions and suggest that memory information is organized in a way other than that implied by the causal theory. But it is distributed connectionism that actually challenges the causal theory of memory, not only through some of its basic postulates, like the superpositional conception of memory traces, their mutual influence and constant state of change, but also because it is compatible with a more situated approach to memory phenomena as well as with the idea that memory in reality accomplishes a variety of functions that go beyond the representational one. The explicit and implicit ideas provided by distributed connectionism, together with the previous criticisms that we made to of causal theory, clearly suggest the possibility of developing another kind of philosophical theory of memory, different from existing theories. This task, nonetheless, implies: (a) A much deeper study of connectionism principles and memory models, as well as of the rival candidate, symbolism, plus the evaluation of these models in the light of psychological and neurophysiological empirical research, which unfortunately I have not dealt with in this work. (b) An analysis of the metaphysical nature of events and facts, in order to see if we should decide in favor of a realist or a non-realist account. It is also clear that this decision can’t be taken without an examination of perception studies (and not exclusively philosophical ones) which would be crucial for determining what is encoded in memory, and studies devoted to language, which, I suspect, plays an important role in the segmentation of reality. (c) A clarification of the notion of causality, because we wouldn’t like to deny any kind entail the complete disappearance of boundaries between memory and imagination. And even if I suspect that my future work will question the existence of absolute boundaries between these two capacities, the notion of causality can’t be completely erase from the theory of memory without erasing the memory phenomenon itself. But this causality, as we’ve already showed, can’t consist in the naïve conception adopted by the causal accounts of memory, nor can it be explained in counterfactual terms. If we think of the reconsolidation concept, of the interdependence between all the memory system, and of the deciding influence of context, it’s almost sure that more than one notion of causality will need to be invoked in order to explain memory. (d) Because I do not want to reduce the study of memory exclusively to cases of remembering, it’s essential to analyze how memory intervenes not only in imagination, but also in perception, reasoning and future projection, for example. In this respect, we could quote the interesting articles of Atance & O’Neill (2001) and Bucker & Carroll (2006), the first concerning the relationship between episodic memory and episodic future thinking, the second concerning the relationship between episodic memory and all kinds of self-projection, such as navigation and theory of mind, relations that would also have to be explored from a philosophical perspective, in particular to overcome the tendency to suppose that representation is the only function of memory. I will also mention the necessity of combining the notion of metamemory with that of memory to some extent; as I have already remarked, it is implausible to suppose that a subject who consciously remembers something is unable to exert any kind of control over his memory reports. (e) Finally, in order to integrate a situated conception of memory into a philosophical account, it will also be indispensable to take into consideration what is known as “everyday memory research” as well as studies in social and collective memory. In this paper I argue against two prevailing views of Kant’s Religion. Against commentators such as Michalson and Quinn, who have argued that Kant’s project in Religion is riddled with inconsistencies and circularities, I show that a proper understanding of Kant’s views on grace reveals these do not exist. And contra commentators that attribute to Kant at best a minimalist conception of grace, I show that Kant’s view of it is remarkably robust. I argue that Kant works with three different (...) conceptions of grace. These are: a) grace and the God within, b) grace and the transformation of the fundamental orientation, and c) grace that can be laid hold of; the first and the last play a significant role in his philosophy of religion. Abstract: In this paper, I respond to James Sterba’s recent book ‘Is a Good God Logically Possible?’ I show that Sterba concludes that God is not logically possible by ignoring three important issues: (a) the different functions of leeway indeterminism (and the political freedom presupposed by it) and autonomy (the two are very different things, even though both go under the name of freedom), (b) the differences in the conditions of agency in God and in creatures, (there is non-parity in (...) how each must apply the single moral law), and (c) the non-parity between our knowledge and God’s. I provide a brief summary of Sterba’s arguments, and I develop the following points: 1. Sterba’s argument against a Free-Will Defense hinges on his conflation of political freedom and autonomy; 2. Sterba’s crucial premise for his argument against soul-making theodicies (namely, that the “Pauline Principle” should be applied univocally across God and creatures) is false; 3. Sterba’s arguments against skeptical theism depend on his assumption that our knowledge is comparable to that of God. In each case, Sterba either does not recognize non-parity between God and creatures or does not recognize the difference between the profane (e.g., political matters) and the sacred, (e.g., spiritual matters having to do with the inner nature of the soul’s development). One of the principle aims of the B version of Kant’s transcendental deduction is to show how it is possible that the same “I think” can accompany all of my representations, which is a transcendental condition of the possibility of judgment. Contra interpreters such as A. Brook, I show that this “I think” is an a priori (reflected) self-consciousness; contra P. First, that Aristotle's considered view of time is intrinsically tied to a language of temporal passage heavily dependent on the A-series.1 As such Aristotle's understanding of time is plagued with the perplexities that the A-series generates.2 Second, that the series of puzzles that Aristotle treats in (...) IV. 10, leading to the conclusion that time is non-existent, are left unanswered by Aristotle.3 [End Page 169] Instead, after presenting the puzzles having to do with whether time is, Aristotle cannot move fast enough to his treatment of what time is, leaving the puzzles unresolved.4 In this paper we would like to look at these two issues together. Our thesis is that the puzzles about the existence of time discussed by Aristotle at IV.10 are generated by a particularly naïve version of the A-theory. Further, although Aristotle's answer to what time is incorporates elements of an A-theory of time, it manages to avoid just those particular puzzles discussed in IV. 10 leading to the conclusion of time's non-existence.Our discussion is divided into three parts. First we provide an analysis of the puzzles raised by means of the commonplace ideas () mentioned by Aristotle at 217 b 31. This analysis will reveal that the puzzles are the consequence of a hypostatization of time, that is, the naïve notion that time has metaphysical status in its own right, in the way that a substance has, for instance. The hypostatization of time is what results when we ask questions concerning when the now exists and when the now ceases to be. We argue that these are questions that arise when the present is thought of as something that becomes, that is, that surges forward through history. Moreover, the problems brought to light by these puzzles are not left unresolved by Aristotle. Rather, Aristotle's considered view of time, piggybacking as it does on substances and their changes, would clearly avoid such a reification of time and hence the problems generated by it. In the second part of the paper we discuss Aristotle's view of the substrate of time, namely change, and show why Aristotle argues that change must be thought of as following a magnitude. Using our discussion in section 2 as our basis, in the third and final section we discuss the [End Page 170] significance of Aristotle's theory of time as that which results when we measure one change by another. Our discussion in sections 2 and 3 is geared towards an exploration of how Aristotle's own theory avoids a commitment to pure temporal becoming as real, that is, the idea that the now moves through a fixed continuum along which events are arranged in chronological order. The fact that this denial is an implication of his theory is closely linked to Aristotle's solution of the aporias in IV.10.1. TheThe arguments presented in IV.10 concern difficulties arising from common sense views of time. We will argue that these puzzles are the result of a reification of time. Resulting from naïve conceptions of time, they dissolve once these have been replaced by Aristotle's ensuing demystified account of the nature of time. Two things stand out as important in this regard. First, Aristotle's definition of time involves number, and as Aristotle notes at 223 a 22 ff., number exists only insofar as there is a soul that counts. That Aristotle conceives of time as involving a soul that counts should alert to us to the fact that Aristotle does not conceive of time as something that, of itself, marches along a preexisting continuum, first privileging one moment and then another. Second, insofar as the substratum of time is that which is countable in the before and after in change, time is, as it were, a characteristic of substances undergoing change and is not an explanatory condition of their changing. This paper examines how Kant's Copernican shift in philosophy had a decisive influence on philosophical religious thought; reflection on the nature of subjectivity shaped how the question of God was approached and understood. I examine three interrelated issues at the forefront of nineteenth and twentieth-century thought on subjectivity and the problem of God. These are a) the ontological nature of subjectivity and what it reveals about the conditions of possibility of a subject's relation to the Absolute; b) interiority and subjectivity (...) with respect to the subject's relation to God, and c) the theme of the "unhappy consciousness" and how its development led to important attacks on theism. This essay proposes to discuss the manner in which Jan Baptista van Helmont helped to transform the Neoplatonic notions of vital spirit and of ferment by giving these notions an unambiguously chemical interpretation, thereby influencing the eventual naturalization of these ideas in the work of late seventeenth century chymists. This chemical interpretation of vital spirit and ferment forms part of Helmont’s hybrid ontology, which fuses a corpuscular conception of minima naturalia with a non-corporeal conception of semina rerum. For Helmont, chemical (...) alterations involve the minima as physical units but also depend upon ferments that are contained in the semina, which function as formative spiritual agents. Helmont’s nuanced ontology ultimately contributes to the development of modern corpuscularian theory by explaining many chemical reactions in fundamentally corpuscular terms, as the addition and subtraction of particles. The discourse concerning computer ethics qualifies as a reference discourse for ethics-related IS research. Theories, topics and approaches of computer ethics are reflected in IS. The paper argues that there is currently a broader development in the area of research governance, which is referred to as 'responsible research and innovation'. RRI applied to information and communication technology addresses some of the limitations of computer ethics and points toward a broader approach to the governance of science, technology and innovation.
